The Ashaiman District Court has remanded a 43-year-old soldier, WOII Dzisenu, into police custody for allegedly killing a 45-year-old man, Abdul Shaban, at Mawugbezibe near Afienya in the Greater Accra Region.
WOII Dzisenu is facing a murder charge under Section 46 of the Criminal Offences Act, 1960 (Act 29). He did not enter a plea when he appeared before the court.
Presiding over the case, Derick Parden Eshun directed that the accused be kept in police custody until August 27, 2026, when he is expected to reappear before the court.
According to the prosecution, led by Inspector Henry Tetteh Nartey, the case was initially reported at the Afienya Police Station on August 13, 2025.
The court heard that WOII Dzisenu and another soldier, WOI Yamoah Mark, both attached to the Base Ammunition Depot (BAD) at Michel Camp, went to the police station following an incident at their property at Mawugbezibe.
The prosecution said the soldiers told investigators that an unidentified man had confronted WOII Dzisenu and attempted to forcibly take an M16 rifle from him.
The confrontation allegedly escalated, resulting in WOII Dzisenu firing the rifle at the man.
Police officers who accompanied the soldiers to the scene reportedly found Shaban lying motionless on the ground with an apparent gunshot injury around his upper chest and neck.
He was pronounced dead at the scene, after which his body was transported to the Tema General Hospital mortuary for preservation and post-mortem examination.
Police subsequently took possession of the M16 rifle, with serial number 000470-11, together with its magazine and ammunition, for further investigations.
A post-mortem examination conducted by Dr Eric Dunfeh, a pathologist at the Tema General Hospital, reportedly established that Shaban died from a perforating gunshot wound to the heart.
A bullet recovered from the deceased’s body was also sent to the Police Forensic Laboratory for ballistic analysis.
Inspector Nartey told the court that the pathologist’s findings indicated that the gunshot was fired from near-contact range and at an angle.
The report further suggested that the shooter was likely positioned above the deceased at the time the shot was fired.
The prosecution added that both soldiers subsequently provided written caution statements to the police as investigators sought to establish the presence of an independent witness.
The case docket was later forwarded to the Attorney-General’s Office for advice.
Following the advice received, WOII Dzisenu was formally charged with murder and brought before the Ashaiman District Court, where the court ordered his remand in police custody until August 27, 2026.
The allegations against WOII Dzisenu are yet to be proven in court. He is presumed innocent until proven guilty.
